`Homicide occurs when one person kills
another person as a result of an intentional
action or omission. Not all homicides are
criminal offenses. When the State executes a
death sentence against a prisoner, for
example, that is homicide. One also commits
homicide if one kills an attacker to defend
oneself against imminent serious injury or
death.
But one cannot be held criminally liable for
such acts. One can be held criminally liable
for a homicide only if it occurs as the result of
an act that is unlawful, malicious or reckless.
The two main forms of criminal homicide in
Nebraska are murder and manslaughter.
