In a lawsuit for a personal injury, the injured
party, the plaintiff, files a complaint, usually in
state court but sometimes in federal court. The
defendant, or defendants, are those
parties,(people, corporations, associations, etc.)
from whom the plaintiff is seeking money
damages.
To win lawsuit for negligence against a
defendant, a plaintiff needs to prove to the court
that the defendant had a duty to the plaintiff, that
the defendant breached that duty, and that, as a
result the plaintiff suffered harm.
